TERMS AND CONDITIONS

Agreement: This is a legal agreement between you, the customer (“customer”), and the owner of chakramall.com and incensemall.com, Kimberly Gunn of Port Charlotte Florida ( "vendor"), with regard to products (“products”) you buy from this site (“website”). By purchasing products from the website, you agree to be bound entirely by the terms of this agreement. If you do not agree to the terms of this agreement, please do not purchase.

1. Restrictions. You must be 18 years of age or older to purchase products from this site

2. Use of products. The customer agrees to abide by all instructions and warning labels on the products especially incense and oils. All products must be used with care and kept out of the reach of children. None of these products can be consumed. Lit incense can cause fire. Keep oils away from eyes, skin and naked flame. Oils can damage furniture and some plastics. The customer assumes all responsibility for correctness and safety of use as in section 3. below.

3. Limited Warranty PRODUCTS PURCHASED FROM THIS WEBSITE OR INFORMATION AND ACCOMPANYING MATERIALS ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE VENDOR, HIS/HER AGENTS, OR ASSOCIATES, SHALL CREATE A WARRANTY, OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE. . THE VENDOR DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF USE, OF THE PRODUCTS OR WRITTEN MATERIALS IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE, AND THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCTS IS ASSUMED BY YOU, THE CUSTOMER.

NEITHER THE VENDOR, OR ANY CONTRIBUTOR, DEALER, AGENT, ASSOCIATE OR OTHER PERSON OR PERSONS WHO CONTRIBUTE TO THIS WEBSITE OR ITS PRODUCTS, ORIGINATION, SALE OR DELIVERY SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, AND THE LIKE) ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT OR RELATED TO THIS AGREEMENT, EVEN IF THE VENDOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
 

IN NO EVENT SHALL THE VENDORS LIABILITY EXCEED THAT OF THE PURCHASE PRICE OF THE PRODUCTS
 

4. Delayed or damaged Goods The vendor takes every care in the packaging and labeling of shipments and uses only proprietary shippers and carriers - however once the products leave us we have no control of their handling or the timing of their arrival. Any damage or late claims must be directed to the carrier – whose details we will pass on to you, the customer, upon request.
 

5. ecommerce. The vendor uses Paypal.com as the website’s approved ecommerce solution for payments. When paying you are redirected to paypal.com's site. Any payment issues, credit card or payment security issues must be addressed to paypal.com – the vendor has no control of this process.
 

6. Copyright. The website is owned by the vendor and is copyright of same. All images and descriptions used are to the best of the vendors knowledge - copyright free. Should it be brought to the vendors attention that any image or description is being used subject to copyright the vendor limits his/her liability to removal of the disputed item.
 

7. General. This Agreement and any dispute under it will be governed by the laws of the State of Florida and the United States of America, without regard to their conflict of laws principles. This Agreement constitutes the entire agreement between you, the customer, and the vendor with respect to its subject matter, and supersedes other communication, advertisement, or understanding with respect to the website and products. This Agreement may not be amended or modified except in a writing executed by both parties If any provision of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect.
 

8. ACKNOWLEDGMENT BY PURCHASING PRODUCTS FROM THIS WEBSITE YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING AND THAT YOU AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU ALSO AGREE THAT THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF AGREEMENT BETWEEN THE PARTIES AND SUPERSEDES ALL PROPOSED OR PRIOR AGREEMENTS, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN THE PARTIES.
